This notice describes how medical information about you may be used and disclosed and how you can get access to this information. Please review it carefully.

Your Rights

When it comes to your health information, you have certain rights. This section explains your rights and some of our responsibilities to help you.

  • You may ask to see or obtain an electronic or paper copy of your prescription records and other protected health information

    we maintain about you. We will provide a copy or summary, usually within 30 days of your request. We may charge a

    reasonable, cost-based fee as permitted by law.

  • You may ask us to correct health information that you believe is incorrect or incomplete. We may deny the request in some

    circumstances, but if we do, we will explain why in writing within the time required by law.

  • You may ask us to contact you in a specific way, such as at a particular phone number, or to send communications to a different address. We will accommodate reasonable requests.

  • You may ask us not to use or share certain health information for treatment, payment, or health care operations. We are generally not required to agree. If you pay for a health care item or service out of pocket in full, you may ask us not to disclose information about that item or service to your health plan for payment or health care operations, unless the law requires us to do so.

  • You may ask for an accounting of certain disclosures of your health information made during the six years before your request. The accounting generally does not include disclosures for treatment, payment, health care operations, or certain other disclosures excluded by law. One accounting in a 12-month period is provided without charge; a reasonable, cost-based fee may apply to additional requests.

  • You may ask for a paper copy of this notice at any time, even if you agreed to receive it electronically. We will provide a copy promptly.

  • If someone has legal authority to act for you, such as a health care power of attorney or legal guardian, that person may exercise your privacy rights. We will verify the person's authority before taking action

  • You may complain to Tidewater Pharmacy & Compounding by contacting our Privacy Officer at help@tidewater.com or 843-375-6310. You may also file a complaint with the U.S. Department of Health and Human Services, Office for Civil Rights. We will not retaliate against you for filing a complaint.

Your Choices

For certain health information, you may tell us your preferences about what we share. If you have a clear preference, tell us what you want us to do and we will follow your instructions when the law gives you that choice.

• Sharing information with family, friends, or others involved in your care or payment for your care.
• Sharing information in a disaster-relief situation. • Certain marketing activities or the sale of your health information, when authorization is required by law.
• Other uses and disclosures for which HIPAA or another applicable law requires your written authorization. If you are unable to tell us your preference, for example because you are unconscious, we may share information if we believe it is in your best interest and the law permits the disclosure. We may also share information when needed to lessen a serious and imminent threat to health or safety.

How We Typically Use or Share Your Health Information

  • We may use your health information and share it with pharmacists, prescribers, other health care professionals, and entities involved in your treatment. For example, we may contact your prescriber to clarify a prescription or coordinate your medication therapy

  • We may use and share your health information to operate the pharmacy, improve the quality of our services, manage your care, train staff, conduct quality assessment activities, and contact you when necessary.

  • We may use and share your health information to bill and obtain payment from health plans, pharmacy benefit managers, insurers, or other entities responsible for payment for your prescriptions or services.

Other Uses and Disclosures Permitted or Required by Law

  • We may share health information for certain public health activities, including preventing disease, assisting with product recalls, reporting adverse reactions to medications, reporting suspected abuse or neglect when authorized or required by law, and preventing or reducing a serious threat to health or safety

  • We may share information with health oversight agencies for activities authorized by law, including audits, inspections, investigations, licensure, and accreditation activities.

  • We may use or share health information for research when applicable legal requirements are satisfied.

  • We will share information when federal or state law requires it, including with the U.S. Department of Health and Human Services if it requests information to determine our compliance with federal privacy law.

  • We may share health information with organ procurement organizations when applicable.

  • We may share health information with a coroner, medical examiner, or funeral director when permitted or required by law.

  • We may use or share health information for workers’ compensation claims, certain law-enforcement purposes, health oversight, and other government functions when permitted or required by law.

  • We may share health information in response to a court or administrative order, subpoena, discovery request, or other lawful process when the applicable legal requirements are met.

Substance Use Disorder Records

To the extent Tidewater Pharmacy & Compounding creates or maintains substance use disorder patient records that are protected by 42 CFR Part 2, additional federal confidentiality protections may apply. Such Part 2 records generally may not be used or disclosed in civil, criminal, administrative, or legislative investigations or proceedings against you unless you provide written consent or the disclosure is authorized by a court order and subpoena as required by law.

Our Responsibilities

• We are required by law to maintain the privacy and security of your protected health information.
• We will notify you promptly if a breach occurs that may have compromised the privacy or security of your information, as required by law.
• We must follow the duties and privacy practices described in the notice that is currently in effect and make a copy available to you.
• We will not use or share your information other than as described in this notice unless you authorize us in writing or another law permits or requires the use or disclosure. If you give us written authorization, you may revoke it in writing at any time, subject to legal limitations.
• We will comply with applicable federal and South Carolina laws that provide greater privacy protections or impose additional restrictions on particular types of health information.

Changes to the Terms of This Notice

We may change the terms of this notice, and the changes may apply to all health information we maintain about you. If we materially change our privacy practices, the revised notice will be available upon request, at the pharmacy, and on our website.

You may also file a complaint with the U.S. Department of Health and Human Services, Office for Civil Rights. Information about filing a complaint is available through HHS. Tidewater Pharmacy & Compounding will not retaliate against you for filing a complaint.
