Your Rights

When it comes to your health information, you have certain rights. This section explains your rights and some of our responsibilities to help you.

Your Choices

For certain health information, you may tell us your preferences about what we share. If you have a clear preference, tell us what you want us to do and we will follow your instructions when the law gives you that choice.

• Sharing information with family, friends, or others involved in your care or payment for your care.
• Sharing information in a disaster-relief situation. • Certain marketing activities or the sale of your health information, when authorization is required by law.
• Other uses and disclosures for which HIPAA or another applicable law requires your written authorization. If you are unable to tell us your preference, for example because you are unconscious, we may share information if we believe it is in your best interest and the law permits the disclosure. We may also share information when needed to lessen a serious and imminent threat to health or safety.

Substance Use Disorder Records

To the extent Tidewater Pharmacy & Compounding creates or maintains substance use disorder patient records that are protected by 42 CFR Part 2, additional federal confidentiality protections may apply. Such Part 2 records generally may not be used or disclosed in civil, criminal, administrative, or legislative investigations or proceedings against you unless you provide written consent or the disclosure is authorized by a court order and subpoena as required by law.

Our Responsibilities

• We are required by law to maintain the privacy and security of your protected health information.
• We will notify you promptly if a breach occurs that may have compromised the privacy or security of your information, as required by law.
• We must follow the duties and privacy practices described in the notice that is currently in effect and make a copy available to you.
• We will not use or share your information other than as described in this notice unless you authorize us in writing or another law permits or requires the use or disclosure. If you give us written authorization, you may revoke it in writing at any time, subject to legal limitations.
• We will comply with applicable federal and South Carolina laws that provide greater privacy protections or impose additional restrictions on particular types of health information.

Changes to the Terms of This Notice

We may change the terms of this notice, and the changes may apply to all health information we maintain about you. If we materially change our privacy practices, the revised notice will be available upon request, at the pharmacy, and on our website.

You may also file a complaint with the U.S. Department of Health and Human Services, Office for Civil Rights. Information about filing a complaint is available through HHS. Tidewater Pharmacy & Compounding will not retaliate against you for filing a complaint.
